Booking Terms and Conditions

Our terms and conditions offer essential guidance about information such as cancellations, amendments and deposits. 

The Parties

The parties to this Contract are: 

(a) "the Customer": the person who makes the booking, must be 18 years of age or over at the time of booking and who shall assume responsibility for all party members and visitors; and, 

(b) "the Owner": Amber Lane Farm Estates Ltd 

Description of Occupancy:  The property may be occupied for private holiday use only, and the tenancy created by this booking is not an assured tenancy, nor an assured shorthold tenancy. 

Commencement and operation of contract

The Guest who makes the booking agrees to these Terms and Conditions, will be responsible for all persons including in the booking, and should ensure they are all aware of the Terms and Conditions.  

We would advise in the first instance that all bookings are provisional until confirmed by Amber Lane Farm Estates Ltd in writing, accepting the booking to the customer. 

Payments 

A booking for a holiday will only be confirmed when a deposit of 30% has been received by Amber Lane Farm Estates Ltd to secure the booking. This deposit is non-refundable and non-transferable. Once your deposit has been received, we will write and confirm your booking. 

The balance of the booking is due in full before the start of your holiday and must be received by the Amber Lane Farm Estates Ltd no later than 6 weeks before your arrival date. (42 days prior to arrival). 

If a guest fails to pay their balance by the due date the booking may be cancelled by Amber Lane Farm Estates Ltd and the deposit will be retained. 

All payments shall be made to Amber Lane Farm Estates Ltd. 

All payments once paid are non-refundable or non-transferable. 

If the Customer books less than 6 weeks before the arrival date, payment of the total cost including the deposit shall be due immediately.

Value Added Tax 

VAT is included in the quoted price for your holiday at the rate applicable at the time of printing. Our confirmation of booking is not a VAT invoice. If VAT rates change, Amber Lane Farm Estates Ltd reserves the right to amend prices accordingly.  

Extra Costs to consider 

Hot Tub £250.00, to be agreed at booking 

Security Bond 

Amber Lane Farm Estate Ltd reserves the right to charge a returnable deposit/bond of £500 upon arrival against any damage that may arise, which is payable when the balance of the booking payment is made. The bond will be held against any damages. The deposit will be refunded within 10 working days of the end of the holiday, subject to no retentions being made. 

Short Breaks 

Amber Lane Farm Estates Ltd Property, The Farmhouse is available for short breaks. The minimum stay is for three nights.  Short breaks are available in low, and peak season either for 3 nights from Friday to Monday or 4 nights Monday to Friday or 7 nights from Friday to Friday – there shall be no variation from this. 

Changes to the Booking 

Should you need to make a change to the dates of a confirmed booking (subject to availability), an administration fee of £40 is payable. 

Insurance

We strongly recommend that you to take out appropriate holiday insurance so that you are covered should you have to cancel involuntarily, for loss of belongings, and for accidents which could occur during your stay.  

Damage, Loss, Theft

Any loss or damage to holiday cottage contents should be notified to us in order that replacement or repairs can be carried out. Only in the event of the repair or replacement costing in excess of £50 would we look to recover the cost. 

The Owner, Amber Lane Farm Estates Ltd has the absolute right to refuse any booking and or refuse to hand over the key to any guest or person accompanying a Guest who has not complied with these Terms and Conditions. 

In this case, monies received will be promptly returned to the Customer. The Owner, Amber Lane Farm Estates Ltd reserves the right to cancel or alter arrangements made for the customer, whether before or during the relevant visit (a) Where any error has arisen regarding availability, (b) in any circumstance that arises from or is attributable to acts, events, omissions or accidents beyond the control of the Owner or (c) where in the reasonable opinion of the Owner, it is necessary to perform or complete essential remedial or refurbishment works. 

Liability

No liability can be accepted by Amber Lane Farm Estates Ltd where you or your personal property suffer any loss, damage, disappointment, inconvenience or otherwise or where the performance or prompt performance of any obligations of the property owner or Amber Lane Farm Estates Ltd is caused, prevented or delayed by any event which is beyond the reasonable control of Amber Lane Farm Estates Ltd, including war, threat of war, riot, civil strife, industrial action, terrorist activity, nuclear disaster, natural disaster, fire, flood, adverse weather conditions or interruption to utility services. Nothing in these terms and conditions shall limit or exclude Amber Lane Farm Estates Ltd liability for death or personal injury arising from its negligence or for fraud or fraudulent misrepresentation. 

Amber Lane Farm Estates Ltd is responsible for providing the property in a good and clean conditions for your stay with fixtures and fittings in good working order. Amber Lane Farm Estates Ltd will not be responsible for , nor liable to guests for any events outside the owners reasonable control, temporary invasion of pests, building works at adjacent properties, damage resulting form exceptional weather conditions or other unforeseeable circumstances. 

Rectification of minor defects, items which may not be present, and minor damage, which is not fundamental to the enjoyment of the property

Description of Property  

We endeavour to describe our property as accurately as possible and to the best of our knowledge the details relating to any property are correct. However, we cannot accept any liability if you find that the property you have booked does not meet your expectations, and we would advise you to view our property prior to making a booking. These instances will not be refunded as they have not caused any fundamental upset to your enjoyment of the property. Need to word this more professionally. 

Amber Lane Farm Estates Ltd accepts no liability for any defects or unavailability of the property. 

Feedback forms are provided at the end of your stay and are welcomed. 

Loss of visitor Property

We cannot accept any liability for the loss or damage to any belongings of the visitor/s and their guests, and we accept no liability for any injury sustained by the visitor/s and their guests 

Your (and any members of your party) personal belongings and vehicles are left at the property entirely at your own risk. Amber Lane Farm Estates Ltd can accept no liability to you or any member of your party for loss or damage to your personal property.  

Right of Entry

We want you to enjoy your holiday/break uninterrupted, and as peacefully as possible. There may, however, be occasions where the owner, Amber Lane Farm Estates Ltd and/or his agent may require access to the property, and in such circumstances we will try to give you reasonable notice.

Services

Unless otherwise specified, the holiday price will include all charges for all services, including water, gas/electricity, oil (where applicable) and council tax.

Cancellation******

(a) By the Customer 

Non-payment of the balance of rent by the due date will cancel the booking and the booking deposit of 30% of the total cost of the holiday shall be forfeited.  

The booking may be cancelled at any time before 8 weeks by the Customer giving Amber Lane Farm Estates Ltd notice in writing. On receipt of written cancellation Amber Lane Farm Estate Ltd will endeavour to re-book the accommodation for the holiday period and, if successful for the whole or part of the period, will refund the relevant proportion of the money paid less £100 to cover office administration. Amber Lane Farm Estates Ltd reserves the right to discount the cost of a cancelled week for late availability bookings, which may lead to no refund being payable. 

If the customer cancels the booking for any reason following payment in full for the holiday, the entire sum paid is forfeited. 

Once a booking has been accepted by the Amber Lane Farm Estate Ltd it can only be changed to a different date by treating the original booking as a cancellation. Please refer to applicable cancellation terms above. 

You are strongly advised to take out independent holiday cancellation insurance to cover you for having to cancel your holiday due to any conditions which may affect your journey to the property booked. Force majeure includes any event which we could not, even with all due care, foresee or avoid. Such events will usually include (whether actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics, fire, closure, restriction or congestion of airspace, airports and ports and all other events outside our control or the UK Foreign Office advice. Please refer to applicable cancellation terms above. 

(b) By the Owner, Amber Lane Farm Estates Ltd 

If, due to circumstances beyond the Owner's control, the Customer's booking is cancelled, the Customer shall be refunded the full amount of the booking in an equal amount to time remaining. We cannot, however pay any compensation or expenses as a consequence of such an event. 

Arrival and Departure of stay

The Customer should arrive no earlier than 4pm at Amber Lane Farmhouse on the start date of the holiday and leave no later than 10am on the final day.

Occupancy

The number of people occupying the property cannot not exceed the maximum number stipulated on your confirmation of booking Form, what is stated in the brochure or on the website. 

The Customer must not use the accommodation or allow its use for any dangerous, offensive, noisy, illegal or antisocial activities or carry on there any act that may be a nuisance or annoyance to the Owner, Amber Lane Farm Estates Ltd or any neighbours.

The accommodation is designed for family use, not for youth groups or student parties. The Owner, Amber Lane Farm Estates Ltd is entitled to refuse to hand over and to repossess the accommodation if the Owner, Amber Lane Farm Estates Ltd reasonably believes that any damage is likely to be caused by the Customer or the Customer's guests as stated on the confirmed Booking Form.

Sleeping in vehicles, including caravans, parked in or around the property is not permitted. 

Access

Access is through a private gated drive, off a busy road, so please take care and have extra caution on entry and leaving the property throughout your visit. You must ensure that whenever the property is unoccupied it is properly secured by ensuring that all doors and windows are closed and locked as well as the electric main gate to the property is also closed on departure.

Cleaning

Our Responsibilities. 

We will ensure that the property is thoroughly cleaned prior to your arrival, and we expect it to be left in a similar condition and state of repair when you depart 

Your Responsibilities  

If the property is left in an unsuitable condition at the end of your let then we will instruct professional cleaners to clean the property and the cost of this will be deducted from your security deposit.   

We reserve the right to deduct from your security deposit any additional cleaning costs incurred as a result of extra cleaning required after your let. 

Pets

Unfortunately, Pets are not allowed at this property. It is not a suitable location for pets and  accordingly accept no liability for the safety of pets at the property. 

If you bring pet(s) to the property without the prior written approval of Amber Lane Farm Estate Ltd, you may be refused entry to the property and your letting of the property shall be deemed to have been cancelled and Amber Lane Farm Estates Ltd shall have any liability to you in respect of such cancellation. 

Nuisance

Fireworks

Fireworks are NOT ALLOWED at the Farmhouse and grounds to avoid upsetting local livestock. 

No fireworks, Chinese or sky lanterns (or other lights or illuminations that have naked flames) should be let off from the property (including any garden or grounds). 

Wildlife

The Farmhouse Holiday cottage at Amber Lane Farm Estates Ltd is an old building, and in a beautiful rural area and keeping all wildlife from being near or entering the property occasionally can be hard depending upon the time of year. We have made all the necessary secure arrangements to try to make it secure but on occasion wildlife may appear. Old properties are part of their environment and cannot be sealed off from the surrounding countryside. It is a beautiful place to stay and therefore expect to meet some wildlife including spiders, the odd mouse, birds, bats, bees, wasps, ants or any other creature which may make their way into a property unbeknownst to the Owner. Usually, it will be a temporary issue and any wildlife event is outside the owners’ control. Please bear this in mind before booking and if this is likely to be a problem for you, it might be best not to book.

Photography

Amber Lane Farm Estates Ltd cannot accept if you are disappointed with the property after looking at the website and being disappointed with your interpretation of its photography and offerings. You take on the booking at your own risk. 

We take photographs of our property and guests should be aware that gardens can change over time, and changes to trees and shrubs may occur and it is sometimes difficult to upkeep our website in time for your booking so these changes over the seasons can sometimes not be accurately represented on the website.

No Smoking

Smoking is not permitted in our holiday cottage. A cleaning fee will be applied after departure for any guests that have been found to have done so and broken our agreement. You will be fully liable for any damage done to the property or its contents during your let, and the cost of repairing the property or replacing contents will be deducted from of your security deposit. Should the cost of repairs or replacements exceed the amount of your deposit, you will be liable to pay the excess.

Complaints/equipment faults etc

If you are having a problem with any of the equipment in the property or have feedback about the service or standard of accommodation, please do so at the time the problem occurs by first contacting the caretaker (where applicable) or on 07951 147869  To give us the opportunity to resolve it quickly.
